The firm frequently serves as counsel to mortgage companies, commercial banks and life insurance companies in the enforcement of their claims. Each year, we process and complete hundreds of mortgage foreclosures throughout the state and in federal courts.
Doyle & Foutty, P.C. also counsels bankruptcy trustees and receivers in the handling and liquidating of estates and businesses in financial trouble, and has helped many such clients avoid serious problems.
The firm represents clients in state and federal courtrooms, and in arbitration and mediation proceedings. Our litigation expertise and practical experience covers a broad range of complex matters involving creditors’ rights, real estate, contracts, lender liability, title insurance law, construction and various other areas of commercial and business law.
The firm has prosecuted and defended claims involving multi-million dollar asset purchases or loans, as well as claims involving mortgage lending and title insurance matters before state and federal agencies and quasi-agencies. The firm has appeared before, or actually represented, a variety of such agencies as HUD, the Small Business Administration, Fannie Mae and Freddie Mac. For many years, the firm has represented and been sole litigation counsel to title insurance underwriters doing business in Indiana.
The firm also utilizes arbitration and other alternatives to traditional litigation whenever appropriate.
Title Insurance and Risk Management
A number of the firm’s clients are title insurance companies. Our lawyers have served these clients in many ways – assisting with their claims investigations and opinions, title defense, subrogation rights, agency questions, agency development and acquisition, and underwriting opinions. We have represented title insurers in dealing with the Indiana Department of Insurance and other regulators. We have consulted with and advised the Board of Directors of the Indiana Land Title Association, and assisted its legislative committee in the drafting of proposed statutes and lobbying efforts.
Real Estate Development and Construction
The firm has counseled a number of lenders, real estate owners, developers and brokers on projects – from inception to completion and sale. Our services in the area include negotiating and drafting purchase agreements and leases, obtaining or verifying proper zoning, negotiating financing and providing expert advice on environmental and other legal matters.
The firm has handled numerous transactions involving real estate projects, joint ventures and other complex real estate arrangements.
